Gerard M. McCabe
Gerard is a seasoned attorney with extensive public and private market experience who is skilled in all aspects of both litigation and transactional practices.
Gerard began his legal career with a two-year federal court clerkship with Chief Judge Louis C. Bechtle in the United States District Court for the Eastern District of Pennsylvania. He then worked for several years as a litigator at Montgomery McCracken, where he focused on complex commercial and white collar criminal defense litigation as well as corporate compliance investigations. Gerard next served as an Assistant United States Attorney for the District of New Jersey, where he actively prosecuted federal criminal defendants at both the trial and appellate levels. Since returning to private practice, Gerard has handled all phases of commercial litigation and criminal defense, and has tried, arbitrated and mediated extensively in both state and federal matters. In so doing, Gerard has successfully authored and argued motion and briefs submitted to both federal and state trial and appellate courts, including the United States Supreme Court. Gerard has successfully prosecuted multiple highly complex matters, including two commercial fraud insurance matters involving a significant number of parties. Gerard is currently, among other matters, spearheading the prosecution of a large federal insurance fraud class action.
Gerard also gained significant experience as a business and finance associate with Morgan Lewis and continues to represent privately-held emerging growth businesses and other corporate clients with respect to their commercial, merger and financing agreements. Gerard is especially adept at representing companies regarding their corporate compliance, organizational and governance requirements as well as with respect to drafting and negotiating distribution, service, employment, consulting, software licensing and other commercial/vendor agreements as well as other financial instruments relating to credit facilities and venture capital financings.
